Conditions of use of the application

The purpose of these general conditions of use (hereinafter referred to as “CGU”) is to determine the rules of use of the “Jagger & Lewis” mobile application (hereinafter referred to as the “Application”) published by the company Jagger & Lewis, hereinafter referred to as “Jagger & Lewis”. By installing the Application on your terminal and/or by accessing the Application, as a visitor and/or user, you unconditionally or reservedly accept all of the T&Cs defined below. If you do not wish to accept these Terms of Use, we ask you not to access the Application.

Any visit and/or use of the Application must be in compliance with these Terms and Conditions.

Section 1. DEFINITIONS

Terms beginning with a capital letter in these T&Cs, whether used indifferently in the singular or plural, will have the meaning given to them below:

“Application” refers to the “Jagger & Lewis” software application published and provided by Jagger & Lewis, providing access to the Services, which is available free of charge in the Apple “Apple Store” and the Google “Google Play Store” of Google to be downloaded by the User to their Apple iOS and Android terminal. The Application also includes Content, software, programs, tools (programming, navigation,...), tools (programming, navigation,...), databases, operating systems, documentation and all other elements and services that make it up, updates and new versions that may be brought to the Application by Jagger & Lewis.

Section 2. PURPOSE OF THE APPLICATION

Jagger & Lewis created the first connected object that attaches to your dog's collar and allows you to monitor their well-being, even when you are not there, and to be alerted when something is wrong.

Developed with veterinarians and engineers, the Jagger & Lewis application and connected object allow you to follow the daily life of your dog when you are with him or in your absence and to improve his well-being.

The functionalities related to the application may be modified at any time by Jagger & Lewis without liability being incurred in this respect by anyone.

Section 3. ACCESS TO THE APPLICATION

To access and use the Application, You must have a compatible telephone or a mobile terminal and access to the Internet network.

The Application can be downloaded free of charge from the “Apple Store” and “Google Play Store” platforms on the following mobile terminals:

- Apple® iPhone® mobile phone with the iOS operating system under iOS 10 or higher

- mobile phone with Android® OS 5.0 or higher operating system

The application software version may be updated from time to time to add new features and services.

Section 4. GEOLOCATION

The use of the application's geolocation functionality requires the express prior consent of the user to be geolocated. To do this, the user must activate, if he wishes, the geolocation function directly in the settings of his mobile terminal and accept that the application can use it. This feature can be deactivated or activated at any time and at no cost.

Section 5. FINANCIAL CONDITIONS

The Application is offered free of charge to Users excluding subscription costs with the mobile telephone operator, excluding the costs of connecting and accessing the Internet network and excluding any additional costs invoiced for loading data.

Access to certain non-mandatory services such as absence mode may require subscribing to a paid mode of the application.

Section 6. APPLICATION OF THE CGU AND THE CGV

The CGU and the CGV are applicable to any User of the Application and the Services.

By reserving a product and/or a service for Jagger & Lewis, You accept the Terms and Conditions to which you have access via a hypertext link to the Site.

The User is invited to carefully read and at each visit the Terms of Use, which are accessible by hyperlink on the home page of the Application and may be modified at any time and without notice by Jagger & Lewis.

The Application may be updated regularly. In this respect, any Application downloaded by a User has a limited validity period, taking into account these updates that must be downloaded and any technical, legislative or regulatory changes, over which Jagger & Lewis has no control.

Section 7. INTELLECTUAL PROPERTY OF THE APPLICATION

Jagger & Lewis is the exclusive owner of all intellectual property rights relating to the Application and its Content, subject to the rights of the companies whose license Jagger & Lewis licenses.

Without prejudice to the provisions of article 7, none of the provisions of the CGU may be interpreted as an assignment, a transfer, a sale, a concession, a license, a loan, a rental, an operating authorization granted directly or indirectly by Jagger & Lewis for the benefit of the User on the Application, its Content and/or the Services.

Section 8. LICENSE OF USE

Jagger & Lewis grants the User a personal right to use the Application, Content and Services, which is non-exclusive, revocable, non-transferable, worldwide and free of charge only for their own needs in connection with the use of the Application and the Services, to the exclusion of any other purpose.

It is strictly forbidden for the User to access and/or use the source codes of the Application and/or the software components of the Application.

The User does not acquire any intellectual property rights to the Application, Content and/or Services or any rights other than those granted herein.

This license does not grant the User any right to use the Content. The user is therefore prohibited from reproducing, representing, adapting and/or exploiting either Content.

The user expressly undertakes that the use of the Application will in no way infringe the rights of Jagger & Lewis, and in particular that such use does not constitute an act of counterfeiting, unfair competition or parasitic on the Content.

Section 9. OBLIGATIONS OF THE USER

The User expressly undertakes:

- to download the Application on their equipment exclusively for personal and non-commercial use;

- not to reproduce the Application permanently or temporarily, in whole or in part, by any means and in any form;

- not to use software or processes intended to copy the Content without the prior written permission of Jagger & Lewis.

- not to carry out any adaptation, modification, translation, transcription, transcription, transcription, arrangement, arrangement, arrangement, compilation, decompilation, assembly, disassembly, transcoding, or apply reverse engineering (or “Reverse Engineering”) of all or part of the Application, Services and/or Content;

- not to extract or reuse, including for private purposes, without prior written authorization from Jagger & Lewis, a substantial or non-substantial part of the content of the databases and archives constituted by the Application;

- not to set up systems likely to hack the Application and/or the Content in whole or in part, or likely to violate these Terms of Use;

- to inform Jagger & Lewis as soon as they become aware of an act of piracy and in particular of any illicit or non-contractual use of the Application and/or the Content regardless of the mode of distribution;

- not to sell, rent, sublicense or distribute in any way the Application and/or the Content to third parties.

Section 10. PROTECTION OF PERSONAL DATA

Any personal data that may be collected as part of the use of the Application will be processed and stored in accordance with Law No. 78-017 of January 6, 1978 relating to Information Technology, Files and Modified Freedoms.

Refusal to provide certain personal data may deprive you of access to certain Services.

Section 11. AVAILABILITY OF THE APPLICATION

Jagger & Lewis is committed to making every effort to secure access, consultation, and use of the Application Services. The Application is accessible 24 hours a day, 7 days a week except in the event of force majeure or the occurrence of an event beyond the control of Jagger & Lewis and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Application. Maintenance interventions may be carried out without Users having been notified in advance.

Section 12. LIMITATION OF WARRANTY

Access and use of the Application are at the risk and peril of the User.

The Application and the software are provided “as is” and “as available” without warranty of any kind.

It is the responsibility of all Users to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack.

Section 13. EVOLUTION OF THE GENERAL CONDITIONS OF USE

The applicable T&Cs are those in force on the date of connection and use of the Application by the User. Jagger & Lewis reserves the right to modify, at any time, all or part, the provisions of the T&Cs without prior notice or information to Users in order to adapt them to changes in the Services, to technical, legal or jurisprudential developments or to the implementation of new services.

Any changes made by Jagger & Lewis to the T&Cs will be brought to the attention of Users by simply posting them online. They are deemed to have been accepted without reservation by any User who accesses the Application after such posting. Jagger & Lewis therefore invites all Users to consult the Terms and Conditions regularly.

Any new Service integrating new techniques or new characteristics improving the quality of existing Services will also be subject to these Terms of Use, unless otherwise expressly provided.

Section 14. TERMINATION

Jagger & Lewis may terminate use of the Application at any time by giving You notice of termination.

Upon any termination, (a) the rights and licenses granted to You will terminate and You must cease all use of the Application.

SECTION 16. APPLICABLE LAW

These CGU are subject to French law.

Any dispute or dispute relating to the execution or interpretation of these regulations that cannot be settled amicably between the parties will be submitted to the competent courts under the jurisdiction of the Lille Court of Appeal.
